Terms of Service

White Fin Capital is a brand operated by FBCPA MARKETING FZCO, a company registered in the International Free Zone Authority (IFZA), United Arab Emirates. All subscription billing is processed by FBCPA MARKETING FZCO as the merchant of record. By subscribing to White Fin Capital, you are entering into a contract with FBCPA MARKETING FZCO.

You must be at least 18 years of age to use this service. By creating an account and subscribing, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are accessing the service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

White Fin Capital provides an educational market commentary and trade journal service. The content displayed — including trade examples, execution history, strategy performance overviews, and related data — is provided strictly for educational purposes only. Nothing on this platform constitutes financial advice, investment advice, trading advice, or a recommendation to buy or sell any financial instrument.

White Fin Capital is not a registered investment adviser, broker-dealer, or financial planning firm. We do not provide personalised investment recommendations. You acknowledge that:

• All content is for educational and informational purposes only
• Past performance displayed is not indicative of future results
• All trading involves substantial risk, including loss of capital
• You are solely responsible for your own investment decisions
• You should consult a qualified financial adviser before making investment decisions

FBCPA MARKETING FZCO and White Fin Capital do not manage, hold, accept, or control any client funds or assets. Subscription fees are paid for access to educational content only. Any portfolio or account data shown on the platform represents a model or illustrative account used for educational demonstration and does not represent client money or managed assets.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your login credentials secure and not share them
• Notify us immediately at support@whitefincapital.com if you suspect unauthorised access to your account
• Not create multiple accounts or share your subscription access with others

We may offer a 14-day free trial for new subscribers. During the trial period you will have full access to premium content at no charge. If you do not cancel before the trial ends, your payment method will be automatically charged at the standard monthly rate. You may cancel at any time during the trial through your account settings or by contacting support@whitefincapital.com. Free trials are limited to one per person; creating multiple accounts to obtain additional trials is prohibited.

Your subscription grants you access to White Fin Capital's members-only content on a recurring monthly basis. By subscribing, you authorise FBCPA MARKETING FZCO (via Stripe) to charge your payment method at the applicable monthly rate.

You agree not to:

• Copy, redistribute, republish, or commercially exploit any content from the platform without prior written consent
• Use automated tools, bots, or scrapers to access or extract content from the service
• Reverse-engineer, decompile, or attempt to extract the source code of the platform or its proprietary indicators
• Share, forward, or repost premium content — including trade signals, commentary, or indicator data — to non-subscribers
• Use the service to develop or improve a competing product or service
• Interfere with, disrupt, or attempt to gain unauthorised access to the platform or its infrastructure

Violation of this section may result in immediate termination of your account without refund.

All content on the platform — including but not limited to text, trade data, performance analytics, commentary, the White Fin Indicator, logos, graphics, and software — is the property of FBCPA MARKETING FZCO or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. Your subscription grants you a limited, personal, non-transferable, non-exclusive licence to access and view the content for your own educational use only. No ownership rights are transferred to you.

Initiating a chargeback or payment dispute without first contacting us at support@whitefincapital.com to resolve the issue may result in immediate termination of your account and access to the service. We reserve the right to contest chargebacks we believe are not made in good faith, and to provide all relevant evidence to the payment processor. We encourage you to reach out to us first — we are committed to resolving issues promptly.

We reserve the right to suspend or terminate your account and access to the service at our sole discretion, with or without notice, for any reason including but not limited to:

• Breach of these Terms of Service
• Violation of the Acceptable Use policy
• Fraudulent or abusive conduct
• Non-payment or failed payment

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion. Upon termination, your right to access premium content ceases immediately (or at the end of your paid billing period, if you cancel voluntarily).

You agree to indemnify, defend, and hold harmless FBCPA MARKETING FZCO, White Fin Capital, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with your use of the service, your violation of these Terms, or any investment or trading decisions you make based on content available on the platform.

To the maximum extent permitted by applicable law, FBCPA MARKETING FZCO and White Fin Capital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation any loss of profits, data, or goodwill, arising out of or in connection with your use of the service. Our total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you in the three (3) months preceding the claim. The service is provided "as is" without warranty of any kind.

We strive to maintain continuous access to the platform but do not guarantee uninterrupted or error-free service. We shall not be liable for any temporary unavailability caused by maintenance, updates, server failures, internet disruptions, or events beyond our reasonable control (including but not limited to natural disasters, acts of government, or third-party service outages).

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree, you may cancel your subscription before the changes take effect.

These Terms of Service shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE. If you are a consumer resident in a jurisdiction that provides mandatory consumer protections, those protections are not waived by these Terms.

If any provision of these Terms is found to be invalid, unenforceable, or unlawful by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions shall continue in full force and effect.
